my father received a phone call from someone claiming to be the "sheriffs office".they told him they had papers to serve me tomorrow and asked if any one would be around to sign them.he asked what the papers where about. The caller gave him a number to call and a case number to reference to.when he called the number the person how answerd asked for me,I got on the phone and a man by the name of Gavin Lapree told me i was being served with a civil lawsuit from hsbc bank for none payment on a credit card.He said the amount was 1971.55 and the were adding 2500.00 in court fees.He said i as sent a demand letter and asked why I did'nt respond.I told him i never received said letter and asked if it was sent certified. He told me most definitly it was.he said he would call the bank to confirm I received the letter.he put me on hold for maybe 5 min.,came back and said the bank confirmed I id not receive the letter, it was sent back to them. Then continued to tell me the bank would consider settling this out of court.I was given two offers one for 1971.55 in 5 installments and the other for 971.55 in two installments. After hanging up with him I called Northampton county court house. They told me they had no papers to be served to me.So i called back Gavin and asked him about this he told me that a process server called me not the sheriffs department and that the instant i agreed to the settlement that the request to serve went away.I then called my friend who is a lawyer he said as far as a process serve calling me that was bulls***.He said in the state of pa only a sheriff can serve you.He also told me that would be the first time he ever heard of a sheriff calling be for he came to serve papers.
so I'm filing a complaint with the state attorney generals office and filing a small claims civil suit.anyone else with a problem with this company should know a class action suit can be claimed against them also.
