Afni Collections sent me a "pay or die" letter claiming I owe several hundred dollars to a cell phone carrier I have NEVER used, NOR would EVER use (T-Mobile).

When I contacted Afni, "Jim" told me that the original creditor was "Aerial" and that they showed me having an account with them up through 2002. Which I did NOT.

I explained I did have an account for a "beeper" with Aerial, and then for a cell phone but because Aerial kept charging me for roaming which was supposed to be included in the contract cost and because their service was so poor, I stopped using them when my contract was up and went with a different carrier.

I have no outstanding monies owed to Aerial and wonder why, over ten years later, this is now showing as a bad debt! When I explained to "Jim" that I was NOT using Aerial in 2002 he said they show a payment being made from me for over 200.00 in 2002!

I replied that their records are obviously wrong - because I was NOT using them in 2002 and since this is a record of an invalid debt it is no surprise that they have an incorrect payment record!

Aerial became Voicestream in 1999 so why do their so called "records" show I made a payment to "Aerial in 2002"?

"Jim" said that if I in fact had made a final payment then Aerial would have issued me a final bill stating so. I replied. yes, they most likely did. He told me I needed to produce that bill as proof!

I asked him 'Oh really?" What law stipulates I need to keep bills for ten years or am I supposed to keep them for life?" I have moved several times since I used Aerial. My belongings have been affected by several hurricanes and Aerial itself has become yet a third company (T-Mobile now).

I am NOT required by law to keep final bills for any reason. The only papers I am aware of that need to be kept for any length of time are tax records and those do NOT need to be kept for 10 years!

This Afni collections company has devised some sort of scheme to intimidate people into paying old bills that are already paid! "Jim" kept repeating that Afni would be happy to finalize this debt if I agreed to pay HALF now! I refused of course - because I do NOT owe them ANY thing!

He said Afni would send me proof of the debt within 45 days.
